A brief overview of “Deferred Action for Childhood Arrivals”

DACA gives undocumented individuals a work permit, social security number and the right to be in the United States (U.S.) for 2 years free from deportation. If approved for DACA, you may also apply for permission to leave and re-enter the United States.

You qualify to apply if you:

  1. Were younger than 31 years old as of 06/15/12
  2. Came the U.S. before you were 16 years old
  3. Lived in the U.S. since 06/15/07 up to the date you apply
  4. Were physically present in the U.S. on 06/15/12 and at the time you apply
  5. Have been undocumented since 06/15/12
  6. Are currently in school (high school, college, trade school, etc.), have a high school diploma or G.E.D. or were honorably discharged from the Military
  7. Have not been convicted of a felony, significant misdemeanor, or 3 or more misdemeanors and
    1. Significant misdemeanor includes convictions for domestic violence, burglary, unlawful possession or use of a gun, distributing or selling drugs, or driving under the influence of alcohol or drugs.
  8. Are not a threat to national or public safety

If your felony or significant misdemeanor conviction was expunged or dismissed you should speak to an Attorney before applying for DACA.
